Privacy Policy and Obligations to Provide Information Within the Framework of the EU General Data Protection Regulation (GDPR)

We, the EV Group and its affiliated companies, are delighted that you visit our website and would like to thank you for your interest in our company, our products and technologies.
Protecting your privacy within the framework of using our website and in the broader context of our business relationship is one of our prime concerns. In particular, we are paying close attention to protecting your personal data.
We treat your personal data confidential and warrant that we will process them exclusively based on the legal provisions of the DPA and the EU GDPR.
In this Privacy Policy, we provide you with information about the key aspects of data processing within the EV Group.
Basically, you can also visit and use our website without providing any personal data. Nevertheless, some services and offerings may be subject to other regulations, which we will point out to you separately below.
By visiting our website, you agree to the use of your personal data (hereinafter “data”) in the manner described in this Privacy Policy.

Your personal data will be processed within our company for the following purposes:

We would like to point out that no data protection officer has been appointed, since this is not required by law.

Minors

Our website and our further range of products and services is not intended for use by minors, and we do not want to collect data of minors. If a parent or guardian of a minor takes the view that their child might have provided us with personal data, please address us using the contact details stated below. We will then erase such personal data subject to applicable law and this Privacy Policy.

WHY AND ON WHAT LEGAL BASIS DO WE PROCESS YOUR DATA?

1. To process and respond to your enquiries
If you contact us to be provided with information and/or answers to your enquiries, we may process your data based on your consent acc. to Art. 6 Para. 1 Letter a GDPR and/or Art. 6 Para. 1 Letter f GDPR.
If you contact us, for ex., to conclude a contract with us, we may process your data based on Art. 6 Para. 1 Letter b GDPR and, if need be, based on Art. 6 Para. 1 Letter c GDPR.

2. To handle your order
If you disclose your data by e-mail or in any other manner whatsoever to us, we will process such data, including your personal data, to handle your order within the framework of our business relationship to subsequently process and manage your order as agreed.
We will process your data, including the personal data provided by you and, if need be, any special categories of personal data provided without request and on a voluntary basis, on the legal basis of Art. 6 Para. 1 S. 1 Letter b and Art. 9 Para. 2 Letter a GDPR in order to identify you as a customer, in order to handle the relevant order as agreed and in order to correspond with you accordingly. Any data will be processed upon your request and is required for the purposes specified above to process your order appropriately.
Due to stipulations under commercial and tax law, we are obliged to retain your address, payment and order data. If any contract is concluded, all of the data from the contractual relationship will thus be retained as long as an active business relationship exists. In addition, your name, the company address, the products and services purchased and the purchase date will at least be retained by the end of the product liability period (ten years). Any data will be processed based on the legal provisions of Section 96 Para. 3 TKG (Austrian Telecommunications Act) and of Art. 6 Para. 1 Letter a and/or Letter b GDPR.

3. To process your application in our company

If you are interested in any job offer published on the website of our company or in any other media or have any general interest in any employment in our company, we will process the data provided by you within the framework of your application, including your personal data, in order to evaluate and manage your application quickly and appropriately. We will process such data on the legal basis of Art. 6 Para. 1 S. 1 Letter b and Art. 9 Para. 2 Letter a GDPR in order to handle your application accordingly and in order to correspond with you. Any data will be processed on your initiative and is required for the purposes specified above to process your application appropriately.

4. For marketing purposes

We process your data based on our legitimate interest acc. to Art. 6 Para. 1 S. 1 Letter f GDPR, which constitutes our interest in the initiation of the transaction and intensification of the business relationship with you as an existing or potential customer.

5. Sending newsletters

We will be pleased to inform you at regular intervals about our product and technology innovations and about further news using newsletters. Your personal data collected within the framework of sending newsletters will not be forwarded to third parties. You may withdraw your consent to any processing of your personal data provided to us for sending newsletters at any time. To that end, each newsletter contains a corresponding link. We will subsequently erase your data in connection with the sending of newsletters without delay.

You have the right to request confirmation from us as to whether relevant personal data is processed. If you would like to exercise such right of confirmation, please address our privacy team at any time.

2. Right to information

You have the right to be provided by us with information about the personal data retained about your identity and with a copy of such information free of charge at any time. Such information includes, inter alia,

  • the purposes of processing;
  • the categories of personal data processed;
  • the recipients or categories of recipients to whom the personal data has been or will still be disclosed, especially for recipients in third countries or for international organisations;
  • where possible, the intended duration for which the personal data will be retained or, if this is not possible, the criteria for the determination of such duration;
  • information about the right to correction or erasure of your personal data or to restriction of any processing by us or any right to object to such processing;
  • information about any right to lodge a complaint with a supervisory authority;
  • if the personal data is not collected from the data subject: all of the information available about the origin of the data.

Furthermore, you have the right to be provided with information as to whether any personal data was transmitted to a third country or to an international organisation. If this is the case, you also have a right to be provided with information about adequate guarantees in connection with such transmission.

3. Right to correction or erasure

You have the right to request immediate correction of relevant incorrect personal data.
Furthermore, you have the right to request completion of incomplete personal data, also by a complementary declaration, taking into account the purposes of processing.
If you would like to exercise such right of correction, you may address our privacy team at any time.
Moreover, you have the right to request immediate erasure of your personal data by us if any of the following reasons applies and processing is not required:

  • The personal data was collected for any purposes or processed in any other manner for which it is no longer required
  • You withdraw your consent, on which any processing acc. to Art. 6 Para. 1 Letter a GDPR or Art. 9 Para. 2 Letter a GDPR is based, or any other legal basis for processing is lacking.
  • You object to any processing acc. to Art. 21 Para. 1 GDPR and there are no overriding legitimate grounds for any processing or you object to any processing acc. to Art. 21 Para. 2 GDPR.
  • The personal data has been unlawfully processed.
  • The personal data is to be erased for compliance with a legal obligation in Union or Member State law to which the controller is subject.
  • The personal data was collected in relation to information society services acc. to Art. 8 Para. 1 GDPR.

If any of the reasons specified above applies and you would like to have us erase any personal data retained by us, you may address our privacy team at any time. We will immediately comply with your request for erasure.

4. Right to be forgotten

If we have made any personal data public and our company, as controller acc. to Art. 17 Para. 1 GDPR, is obliged to erase the personal data, we will take adequate measures, also of a technical kind, taking into account the technology available and the implementation costs, to inform other controllers processing the published personal data that you requested such other controllers to erase all links to such personal data or of copies or replications of such personal data, unless processing is required. Our privacy team will arrange for the necessary steps on a case-by-case basis.

5. Right to restrict processing

You have the right to request restriction of processing by us if any of the following conditions has been satisfied:

  • You challenge the accuracy of the personal data for a period enabling us to verify the accuracy of such personal data.
  • Processing is unlawful, but you refuse erasure of the personal data, requesting instead that use of the personal data be restricted.
  • We do no longer need the personal data for the purposes of processing, but you need it to assert, exercise or defend legal claims.
  • You have objected against any processing acc. to Art. 21 Para. 1 GDPR and it has not yet been established whether our legitimate grounds prevail your ground.

If any of the conditions specified above has been satisfied and you would like to have us restrict any processing of personal data retained by us, you may address our privacy team at any time which will then arrange for such processing to be restricted.

6. Right to data portability

You have the right to receive your relevant personal data provided by us in a structured, common and machine-readable format.
Moreover, you have the right to transmit such data to other controllers without hindrance by us, provided that such processing is based on the consent acc. to Art. 6 Para. 1 Letter a GDPR or Art. 9 Para. 2 Letter a GDPR or on a contract acc. to Art. 6 Para. 1 Letter b GDPR and is made using automated processes, unless such processing is required to perform any task carried out in the public interest or in the exercise of official authority vested in us.
Furthermore, when exercising your right to data portability, you have the right to effect that the personal data will be transmitted directly by us to another controller, where this is technically feasible and will not impair the rights and freedoms of others.

7. Right to object to processing

You have the right to lodge an objection against any processing of your relevant personal data that is effected based on Art. 6 Para. 1 Letter e GDPR for reasons resulting from your specific situation.
If you object, we will no longer process your personal data, unless we can demonstrate compelling legitimate grounds for such processing which override your interests, rights and freedoms or we show transparently that such processing serves the establishment, exercise or defence of legal claims.

8. Right to withdraw any consent given under privacy law

You have the right to withdraw your consent to any processing of personal data. To this end, please address our privacy team.

TECHNICAL AND ORGANISATIONAL MEASURES

We implement appropriate technical and organisational measures (TOMs) and protection measures to prevent any unwarranted access, unlawful processing and unauthorised or accidental loss of your data.
In addition, we point out that our company has been certified according to the ISO 27001 (Information technology – Security techniques – Information security management systems – Requirements) international standard and that we have already implemented all necessary technical and organisational measures and protection measures within the framework of said certification.

Google Adwords 

We use services provided by Google Adwords to draw attention to our attractive offers with the help of advertising materials ("Google Adwords") on third-party websites.
